Terms of Service

1. Acceptance of Terms

By creating an account or using the Nurture application ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Noah Willman ("Nurture," "we," "us," "our"), the operator of the Nurture application and its associated services.

2. Description of Service

Nurture is a baby-tracking and pattern-recognition application. The App allows you to:

• Log daily events for your baby (feeds, sleep, diapers, moods, and notes)
• View a history and timeline of logged events
• Share access to your baby's data with invited caregivers

With an optional paid subscription ("Nurture Pro"), the App additionally provides:

• AI-generated daily outlooks based on your baby's observed patterns
• Gentle, non-prescriptive suggestions about what may come next in your day
• A chat interface to ask questions about your baby's logged data
• Pattern and trend analysis across days and weeks
• Voice-to-structured-data entry via dictation

3. Not Medical Advice

The AI-generated schedules, suggestions, and pattern analysis are based solely on the data you log and are intended to help you observe trends in your baby's routine. They are:

• Observational, not prescriptive. Nurture shows you what has happened and what is statistically likely based on your data. It does not tell you what you should do.
• Not a substitute for professional guidance. If you have any concerns about your baby's health, feeding, sleep, development, or well-being, consult a qualified healthcare provider immediately.
• Potentially inaccurate. AI predictions are probabilistic estimates. They may be wrong. Do not rely on Nurture's output as the sole basis for any caregiving decision.

By using the App, you acknowledge that you are solely responsible for all caregiving decisions and that Nurture bears no responsibility for outcomes related to decisions influenced by the App's output.

4. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to create an account and use Nurture. The App is designed for use by parents and caregivers, not by children.

5. Account and Security

• You are responsible for maintaining the security of your account credentials (your Apple ID used for Sign in with Apple).
• You are responsible for all activity that occurs under your account.
• You must notify us immediately if you believe your account has been compromised.
• You may invite caregivers to access your baby's data. You are responsible for managing those invitations and revoking access when appropriate.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to access another user's data without authorization
• Interfere with, disrupt, or place an unreasonable burden on the App's infrastructure
• Reverse-engineer, decompile, or extract source code from the App
• Use the App to collect data about other users
• Use the AI chat or dictation features to process content unrelated to baby caregiving
• Create multiple accounts to circumvent subscription requirements or usage limits

7. Subscription and Billing

7.1 Free Tier

The free tier of Nurture provides unlimited event logging, full history, timeline, and family sharing at no cost. The free tier is available indefinitely and is not a trial.

7.2 Nurture Pro

Nurture Pro is a paid subscription that unlocks AI-powered features. Subscriptions are billed through the Apple App Store.

• Price: $14.99 per month (USD), or as displayed in the App Store at the time of purchase. Pricing may vary by region due to App Store localization.
• Billing: Your Apple ID account will be charged at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Management: You can manage or cancel your subscription at any time through your Apple ID account settings or the App Store.
• Refunds: Refund requests are handled by Apple in accordance with their App Store policies. We do not process refunds directly.

7.3 Changes to Pricing

We may change subscription pricing in the future. Any price change will apply to the next billing cycle after the change is announced. Apple will notify you of price increases and require your consent before renewal at the new price, as required by App Store policy.

7.4 Downgrade

If your subscription expires or is cancelled, your account reverts to the free tier. Your data is not deleted. You retain full access to logging and history. AI features (schedule outlook, suggestions, chat, and dictation extraction) become unavailable until you resubscribe.

8. Your Data

8.1 Ownership

You own the data you enter into Nurture. We do not claim ownership of your events, notes, or any information you provide about your baby.

8.2 License to Operate

By using the App, you grant us a limited, non-exclusive license to process your data as necessary to provide the service -- including sending data to AI providers (Anthropic and OpenAI) for analysis, as described in our Privacy Policy.

8.3 Deletion

You may delete individual events, your entire baby's data (which cascades to all associated records), or request full account deletion at any time. See our Privacy Policy for details.

8.4 Portability

You may request an export of your data in a machine-readable format by contacting us.

9. AI-Generated Content

Nurture uses artificial intelligence to analyze your logged data and generate outputs including schedules, suggestions, profiles, and chat responses. You acknowledge that:

• AI output is not guaranteed to be accurate. Predictions are probabilistic and based on limited data. They may be wrong, especially early in use when the system has little history to work with.
• AI output is not advice. Suggestions like "a nap is probably coming soon" are observational pattern-matching, not recommendations for what you should do.
• AI output may vary. The same data may produce different results at different times due to the nature of large language models.
• AI output should never override your judgment as a parent or caregiver, nor replace professional medical or developmental guidance.

10. Family Sharing

• The account holder who created the baby ("owner") controls access to that baby's data.
• Owners may invite caregivers via a time-limited invite code.
• Caregivers can view and log events but cannot delete the baby, manage invitations, or access the owner's personal account.
• The owner can revoke a caregiver's access at any time, which is effective immediately.
• The owner is responsible for ensuring that all invited caregivers are trusted individuals who should have access to the baby's data.

11. Availability and Service Interruptions

We strive to keep Nurture available at all times, but we cannot guarantee uninterrupted service. The App may be temporarily unavailable due to:

• Maintenance or updates
• Infrastructure outages at our hosting or AI providers
• Circumstances beyond our reasonable control

We are not liable for any loss or inconvenience caused by service interruptions. The logging features of the App are designed to work with intermittent connectivity, and data will sync when a connection is restored.

12. Intellectual Property

The Nurture app, its design, illustrations, icons, code, and brand assets are owned by us and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any part of the App without our prior written consent.

"Nurture" and the Nurture leaf logo are our trademarks. You may not use them without permission.

13. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Without limiting the foregoing, we do not warrant that:

• The App will meet your specific requirements
• The App will be uninterrupted, timely, secure, or error-free
• AI-generated predictions, schedules, or suggestions will be accurate or reliable
• Any errors in the App will be corrected

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NURTURE, ITS OPERATOR, AFFILIATES, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF GOODWILL, OR DAMAGES ARISING FROM:

• Your use of or inability to use the App
• Any AI-generated content, predictions, or suggestions
• Decisions made based on information provided by the App
• Unauthorized access to your data
• Service interruptions or data loss

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

15. Indemnification

You agree to indemnify, defend, and hold harmless Nurture and its operator from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of a third party
• Any caregiving decisions made based on information from the App

16. Termination

You may stop using Nurture at any time and request deletion of your account and data.

We may suspend or terminate your access to the App if you violate these Terms or engage in conduct that we reasonably believe is harmful to other users or our service. We will make reasonable efforts to notify you before or at the time of termination, unless doing so would be impractical or pose a risk.

Upon termination, your right to use the App ceases immediately. Sections 3, 8.1, 13, 14, 15, and 17 survive termination.

17. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction.

CLASS ACTION WAIVER: You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, class arbitration, or other consolidated proceeding.

If arbitration is found to be unenforceable in your jurisdiction, disputes shall be resolved in the state or federal courts located in Travis County, Texas.

18. Changes to These Terms

We may modify these Terms at any time. If we make material changes, we will notify you through the App or by updating the effective date. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

If you do not agree with modified Terms, you should stop using the App and may request deletion of your data.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions shall continue in full force and effect.

20. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Nurture regarding your use of the App and supersede any prior agreements.
